Patent

It is the intention of the owners of the intellectual property ("IP") exposed on this web site ("Architected Futures" and "Joe Van Steen" or "owners") to intentionally foreclose the ability of any and all parties to patent any aspect of the potentially patentable IP exposed on this site which is not already patented. That is the expressed intent and purpose of publication of critical descriptive documentation concerning the methodologies and processes of the Architected Futures methodology and the EATS technology. It is the belief of the owners that there is more value to be achieved by promoting the widest possible use of the IP by the greatest number of people in the widest possible circumstances, rather than providing any barriers to such use. Instead the ideas contained in otherwise patentable portions of the IP are legally constrained in terms of ownership and use only by license agreement. The general ideas and concepts are released as public domain as long as the license agreements are not violated.

Two standard license frameworks are employed for processes, and object sets. A default license arrangement is defined for each set. Utilizations and IP criteria are distinct for process and material. Some licenses offer constraints to objectives for sharing. If intents align, and legal restrictions do not inhibit, "secondary" licenses for specific uses may be obtain on request. Normally:

  1. Creative Commons license, as described below, relative to non operational elements (e.g., concepts and generalized methods)
  2. An Eclipse Public License (EPL) or compatible license for the operational parts of the system (e.g., the EATS software codes). This is primary given the integration between EATS and Eclipse. However, there are other features where there is no issue or desire to be tightly integrated with the Eclipse Core of EATS, rather it is desired to integrate with a technolgy featrure which is based primary on GPL, or Apache, or MIT, etc. The natural binding License for the packaged component is adopted as the software artifact licence for the EATS architected element within the component. Default licenses can be adapted through license injection of override terms in a standard architected form.

These licenses may vary by time frame in which the code is obtained. Additional "secondary" licenses to specific parties for specific uses may be obtain on request.

Other content which might otherwise be legally patentable under United States or International law as either Utility Patent, Design Patent or (potentially) Plant Patent are available free of charge to anyone who wishes to make use of them. Free, as used here, is free as in  no charge, gratis. Some things are free because they have little or no value. Some things need to be free because they are priceless, as in the MasterCard® commercial. Some things need to be free because they are, in truth, products of a long and deep pyramid of aggregated human intelligence and experience, and they belong to everyone. They represent our IP commons, and they need to be managed and guarded as such. Patents don't recognize that. But they should.

Commercial licensing is available where net profits which can be attributed to Architected Futures technology are returned 50% to the growth of the community in which the business is operated as payment for the technology. Proof is a subject for local jurisdiction. This is assumed to create a local systemic growth pattern with a starting regulator on the system set for 50% internal return; 50% return to the community as the balancing point. If Architected Futures tooling helps you create value; so did the people you did business with. What you keep you have. What you give away multiplies and comes back to you. Utilization

Both commercial and non-commercial, and personal and non-personal utilization is encouraged. If you start with Architected Futures tooling, there is no old ecosystem model for use as a base, so there is no heritage payback. In this model we hope your success will be your community's success. Use of concepts is gratis. Makers of all types who may want to utilize Architected Futures tooling or concepts are encouraged to join the Architected Futures discourse
